Labour Agreement

Labour Agreement Negotiations are a part of the employer-sponsored visa process in Australia. A Labour Agreement is a written agreement between the Australian government and an Australian employer that outlines the terms and conditions for employing foreign workers in the country. The negotiation of a Labour Agreement is required for employers who want to sponsor a large number of foreign workers for a specific project or program, and who are unable to find enough Australian workers to fill the required positions.

The negotiation process for a Labour Agreement typically involves the employer submitting a proposal to the Department of Home Affairs, outlining the need for foreign workers, the skills and experience required, the number of workers required, and the wages and conditions to be offered. The Department will then assess the proposal and, if approved, negotiate the terms of the agreement with the employer.

Once a Labour Agreement is in place, the employer can then nominate individual foreign workers for a provided they meet the other eligibility criteria for the visa:

  • Temporary Skill Shortage (TSS) visa (subclass 482)
  • Employer Nomination Scheme (ENS) visa (subclass 186),
